NC Hemp Laws 2026: What You Need to Know
Hemp-derived products are legal in North Carolina right now โ but the biggest federal rule change in a decade lands in November 2026, and it will reshape what's on OBX shelves.
The November 2026 Total THC cliff
A new federal rule redefines "Total THC" as ฮ9 THC + (THCA ร 0.877) combined. Under the old rule, THCA flower was legal as long as ฮ9 was below 0.3% by dry weight. Under the new rule, most current THCA flower will exceed 0.3% Total THC and become federally non-compliant.
What this means on the OBX: shops that built their inventory around THCA flower will need to pivot โ to CBD, ฮ8, beverages, topicals, or minor cannabinoids. Expect shelf changes by December 2026.
What is legal right now (June 2026)
- CBD products with less than 0.3% ฮ9 THC by dry weight
- THCA flower (under the old ฮ9-only rule โ until November)
- ฮ8, ฮ10, and other hemp-derived cannabinoids
- ฮ9 gummies and edibles (hemp-derived, less than 0.3% ฮ9 by weight)
- Topicals, tinctures, beverages
NC 21+ requirement
All hemp-derived products in North Carolina require the buyer to be 21+ as of 2025. Bring ID.
